What you agree to when you use Kromdraw.

Who you are contracting with
Ronkatil B.V., Plataanstraat 7, 6573 XP Beek, Gelderland, the Netherlands. KvK 96968176 · BTW NL867854571B01. "I" on this page means that company, which is one person. Ronkatil B.V. has no parent company and no investors.
What the service is
A shared drawing canvas you reach through a browser, with accounts, folders, sharing links, comments and export. The front page shows what it does, and the comparison pages say what it doesn't.
Accounts
You can create an account to save and share boards. You're responsible for what happens under yours, so keep the password to yourself. If you think somebody else has it, change it from your profile, which signs out every other device and emails you, and then tell me.
You may use Kromdraw personally or for an organisation. If you use it on behalf of an organisation, you confirm that you are allowed to agree to these Terms for it.
You must be at least 16 years old to create or use an account.
Your work stays yours
Everything you draw, write and upload stays yours. I claim no ownership of it and no right to use it for anything except running the service you're using. That means storing it, showing it to you and the people you share it with, making a thumbnail of it, and backing it up.
It isn't used to train a model, and it isn't sent anywhere outside the companies on the subprocessor list, which names all five.
What you may not do with it
- Put anything on a canvas that is illegal where you are or where the servers are, or that you have no right to put there.
- Use somebody else's personal data on it without a basis for doing so. If you're doing that as an organisation, the data processing agreement page applies.
- Put special-category personal data on it, including health data, biometric identification, racial or ethnic origin, political opinions, religious beliefs, trade-union membership, sex life or sexual orientation. Criminal-offence data is prohibited too.
- Try to get at other people's boards, or at the machine the service runs on.
- Load it in a way that degrades it for everybody else. There is one server and it is shared.
- Resell access to it as your own product.
If any of that happens I can suspend or close the account. Where it isn't urgent I'll tell you first and give you time to take your work out.
What is not promised
There is no uptime guarantee and no service level agreement. One person maintains this, there is no external uptime monitoring, and support is an email address. The status page sets all of that out. Things will occasionally be broken and occasionally be slow.
So rely on the export button rather than on this page. It works at any time, without asking me first, and what comes out of it opens in other tools.
Money
Kromdraw costs €9 per permanent member each month or €90 each year, after a 14-day trial without a card. Accountless guests are free. The pricing page has the billing details and commitments.
The payment itself goes through Creem, which is Armitage Labs OÜ in Tallinn, Estonia. Creem is the merchant of record, so it is the legal seller of the subscription and the name on your card statement, and it charges and remits the VAT. Your contract for the service is with Ronkatil B.V.; your contract for the payment is with Creem.
Ending it
You can stop whenever you like. Export first, since that's what the export button is for, then email me from the address registered to the account and ask me to delete it. I can end it too if the section above is broken. If I stop running Kromdraw altogether, I will give at least 60 days' notice. You will need to export before the service closes; after it closes, the data is deleted on the schedule described in the privacy policy.
Liability
To the fullest extent the law allows, Ronkatil B.V.'s total liability is limited to the fees you paid for Kromdraw in the month immediately before the event that caused the claim. This does not limit any liability or consumer right that the law does not allow a contract to exclude or limit. [pending legal review]
Which law applies
Dutch law, and the courts of the Netherlands [to confirm: which court, and how this interacts with consumer protection for customers elsewhere in the EU]. If you're a consumer in another EU country, this page doesn't take away the protections your own law gives you.
Changes to these terms
The date at the top is the last time this changed. A change that materially affects you gets published on this website and emailed to every account holder at least 30 days before it takes effect, unless a legal or urgent security reason requires a change sooner.
